1. Withdrawal period
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen days from receipt of their order to exercise their right of withdrawal, without having to give reasons or pay a penalty, subject to the return costs provided for by law.
Where an order covers several goods delivered separately, this period runs from receipt of the last item.
2. How to exercise your right of withdrawal
To exercise their right of withdrawal, the Customer must notify PAIRFORMANCE of their decision by means of an unambiguous statement (for example by email to contact@pairformance.fr), using the standard withdrawal form at the end of this policy, or directly via the online withdrawal feature available on the website.
The Customer then has 14 days from this notification to return the item(s) concerned to PAIRFORMANCE, unless PAIRFORMANCE offers to collect them.
3. Return costs and conditions
Return costs are the Customer's responsibility. A prepaid return label is provided with each parcel; the corresponding amount is deducted from the refund. Items should, as far as possible, be returned with their tags and accessories, together with the order form or any proof of purchase.
The Customer may handle and try on the product to the extent necessary to establish its nature, characteristics and proper functioning, as they might reasonably do in a shop. They can only be held liable for any diminished value of the goods resulting from handling beyond what is necessary for this purpose. The absence of original packaging cannot, on its own, automatically deprive the Customer of their right of withdrawal.
4. Refund
PAIRFORMANCE refunds the full amount owed, including the delivery costs corresponding to the standard delivery method offered, without undue delay and no later than fourteen days from the date on which PAIRFORMANCE is informed of the Customer's decision to withdraw. For sales of goods, PAIRFORMANCE may, however, defer the refund until the goods have been returned or until the Customer provides proof of having sent them back, whichever occurs first.
The refund is made using the same payment method as that used for the original transaction, unless the Customer expressly agrees to a different method, and provided this incurs no additional cost. PAIRFORMANCE is not required to refund any additional costs resulting from the Customer's choice of a delivery method more expensive than the standard method offered.
5. Size or colour exchanges
PAIRFORMANCE does not offer a direct commercial exchange for a change of size or colour. If the Customer would like a different size or colour, they may exercise their right of withdrawal under the conditions set out above, return the item concerned, and place a new order. This commercial policy does not limit the Customer's rights in the event of a non-conforming or defective product, or one affected by a defect covered by the legal warranties.
6. Exceptions to the right of withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made to the consumer's specifications or clearly personalised, nor to goods unsealed after delivery which cannot be returned for hygiene or health protection reasons.
As of today, no product sold on pairformance.fr falls into these excluded categories.
