The data controller for data collected on the pairformance.fr website is PAIRFORMANCE, a French simplified joint-stock company (SAS) with a share capital of €500, registered with the Nanterre Trade and Companies Register under number 993 728 930, whose registered office is located at 8 B rue Sainte-Marie, 92400 Courbevoie, France. 2. Data collected
As part of account creation, ordering and browsing the website, PAIRFORMANCE may collect the following data: first and last name, email address, postal address, phone number, order history, and connection and browsing data (cookies). No banking data is collected or stored by PAIRFORMANCE: payments are processed directly by the payment providers integrated into the Shopify platform.
3. Purposes and legal bases
This data is processed for the following purposes:
- Processing and tracking orders (performance of the sales contract)
- Managing customer relations and after-sales service (legitimate interest)
- Improving the website and shopping experience (legitimate interest)
- Sending marketing communications, subject to the Customer's consent (consent)
- Compliance with legal and accounting obligations (legal obligation)
4. Data recipients
Data is shared with PAIRFORMANCE and its technical service providers strictly necessary for the performance of the service, in particular:
- Shopify Inc. (hosting and e-commerce platform)
- Payment providers (secure processing of card and PayPal payments)
- The carrier(s) responsible for delivering orders
- Our email and messaging providers, in particular for managing the contact inbox and sending marketing communications
- Where applicable, audience measurement and advertising tools (for example Google Analytics, Meta Ads), only after obtaining your consent where required
These providers use data only to the extent strictly necessary to perform their service. The list of apps actually active on the store may change; this policy is updated accordingly.
5. Data retention period
Retention periods applied depend on the nature of the data:
- Orders and invoicing: for the duration of the business relationship, then accounting records are kept for ten years where required by law.
- Contracts concluded electronically for an amount equal to or greater than €120: kept for the statutory period of ten years, with access to the contract available on request.
- Customer data for marketing purposes: for the duration of the business relationship, then generally three years from its end or from the last relevant purchase.
- Data of prospects and newsletter subscribers: three years from collection or from their last active contact.
- Objection to marketing: the minimum information necessary is kept on an objection list for at least three years, to avoid any further solicitation.
- Cookies and trackers: retention periods appropriate to each tracker are applied; the consent choice expressed is kept for around six months.
6. Data security
PAIRFORMANCE implements appropriate technical and organisational measures, through Shopify's secure infrastructure, to protect personal data against loss, unauthorised access, disclosure or alteration.
7. Transfers outside the European Union
Some of PAIRFORMANCE's service providers, in particular technical providers involved in operating the online store, may process data from countries outside the European Economic Area. Where necessary, PAIRFORMANCE ensures that such transfers rely on a transfer mechanism recognised by applicable regulations, in particular an adequacy decision or the European Commission's standard contractual clauses, together with any additional safeguards where applicable.
This is notably the case for the website's host, Shopify Inc., headquartered in Canada — a country covered by a European Commission adequacy decision — which enters into a Data Processing Addendum with its merchants incorporating the standard contractual clauses.
8. Rights of data subjects
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Customer has the following rights over their personal data: the right of access, rectification, erasure, restriction of processing, objection and portability.
These rights may be exercised by writing to contact@pairformance.fr. The Customer also has the right to lodge a complaint with the French data protection authority (CNIL — www.cnil.fr).
9. Cookies
The website uses cookies necessary for it to function, as well as, subject to the Customer's consent given via the dedicated banner, audience measurement and personalisation cookies. No cookie that is not strictly necessary is placed before the Customer has made a choice, where consent is required.
The cookie management banner makes it as easy to refuse as to accept, allows preferences to be managed purpose by purpose, and can be changed at any time via this banner or browser settings. Refusing certain cookies may limit some website features but does not prevent ordering.
